Court Hearing for Glyphosate Lawsuit Postponed
Bayer has announced that the hearing for the final approval of a class settlement related to glyphosate lawsuits in the U.S. has been postponed to September 14. This decision was made in agreement with the plaintiffs‘ attorneys and aims to give the parties more time to process revocation requests for so-called opt-outs. The possibility of clarifying the validity of some of these opt-outs in advance is a key aspect of this postponement.
Planned Settlement and Its Significance for Bayer
Under the planned settlement, Bayer could pay up to $7.25 billion in decreasing, capped annual payments over a period of up to 21 years. This move aims to largely end the multitude of glyphosate lawsuits burdening the company. However, broad approval from the plaintiffs is required for the settlement plan to take effect. CEO Bill Anderson emphasized back in February the necessity for nearly all plaintiffs to agree to the plan to avoid a non-consent, known as an opt-out.
Supreme Court Decision Strengthens Bayer’s Position
The recent decision by the U.S. Supreme Court in favor of Bayer has led to an increase in revocation requests. The Supreme Court ruled that Bayer cannot be sued for lacking cancer warnings on herbicide packaging. This ruling could undermine many lawsuits based on alleged cancer risks from the glyphosate-containing herbicide Roundup, thereby strengthening Bayer’s negotiating position.
